The HOA super-priority lien
Nevada gives an HOA a lien for unpaid assessments, and a limited portion of it — broadly up to nine months of assessments, plus certain charges — sits in super-priority above an earlier-recorded first deed of trust. Litigation over this has run for years and the rules have been refined by statute and case law.
Two practical consequences. If you buy at an HOA foreclosure sale you may be acquiring something far more valuable than the price suggests, or something encumbered in ways you did not expect.
