How contractor licensing actually works in Texas
This is the part that catches investors coming from California, Florida or the Northeast: Texas does not issue a statewide general contractor license. There is no state GC exam and no state GC number to look up. A person can legally call themselves a general contractor in Texas without holding any state credential at all.
What is licensed at state level is the individual trades:
- Electricians and HVAC/air conditioning contractors are licensed by the Texas Department of Licensing and Regulation (TDLR), and you can verify a licence number on the TDLR site.
- Plumbers are licensed by the Texas State Board of Plumbing Examiners.
- Permits and local registration are handled by the city — Houston, Dallas, San Antonio and Austin each run their own permitting office with their own rules and timelines.
The practical consequence for a flip: your GC may be unlicensed and that is lawful, but the electrical, plumbing and HVAC work they subcontract must be pulled by a licensed trade. Ask who is pulling each permit, get the licence number, and verify it yourself before any money moves. Confirm current requirements directly with TDLR and your city permitting office — rules and fee schedules change.
Why Texas is a non-disclosure state, and why that costs you money
Texas is one of a small group of non-disclosure states: actual sale prices are not recorded in the public record. Deeds are filed, but the consideration is not. You cannot pull a Texas county's records and read what the house down the street sold for.
That has two effects on an investment thesis. First, ARV is genuinely harder to establish — appraisal district values are assessment figures, not market comps, and they lag. Second, it raises the value of every other public-record signal you can get: probate filings, tax delinquency, code citations, evictions, absentee ownership. - Foreclosure sales are held on the first Tuesday of the month, at the county courthouse, in a window between 10:00 a.m. and 4:00 p.m.
- Borrowers must generally receive written notice of sale at least 21 days before that date.
- There is no lengthy judicial process to slow things down, so the gap between default and auction is measured in months, not years.

Texas probate moves faster than most states
Texas is known for independent administration, where an executor can settle an estate with limited court supervision. For investors that means probate property in Texas can reach the market sooner and with fewer procedural hurdles than in a heavily supervised state. It also means the window to reach an heir before a listing agent does is narrower. Probate lists and pre-probate data both apply here; the earlier signal is worth more in Texas than almost anywhere.
Vetting a Texas contractor: a short checklist
- Verify trade licences, not GC claims. Ask for the electrician's and plumber's numbers and check them at the state level.
- Confirm general liability and workers' comp. Texas does not require most private employers to carry workers' compensation, so never assume it is in place. Ask for a certificate naming you.
- Ask who pulls the permit. If a contractor wants you to pull it as the homeowner, you are absorbing their liability.
- Get the scope in writing with a draw schedule. Never fund more than the work completed.
- Ask for two investor references, not two homeowner references. Rehab timelines and retail remodel timelines are different jobs.
