Virginia is among the fastest foreclosure states in the country. It is non-judicial, the advertising period can be very short, and there is no post-sale right of redemption on a deed of trust foreclosure. A distressed Virginia lead has a shelf life measured in weeks.
Class A, B and C: Virginia tiers licences by value
Virginia licenses contractors through the Department of Professional and Occupational Regulation (DPOR), and the distinctive feature is tiering by project and annual value:
- Class C covers the smallest projects and lowest annual volume.
- Class B covers mid-range project and annual values.
- Class A has no upper limit.
A contractor can therefore be fully licensed and still not permitted to take your job, purely on value. Ask for the licence number and the class, confirm both on the DPOR site, and confirm the specialty designation covers the trade you need. Verify current thresholds directly with DPOR — the dollar tiers are revised periodically.
A foreclosure that can be over in weeks
Virginia foreclosures proceed under the power of sale in a deed of trust, conducted by a trustee, without court involvement in the ordinary case. Advertising requirements are driven largely by the instrument itself, and the statutory floor is short — commonly a matter of a couple of weeks of newspaper advertisement.
Critically, once the trustee's sale is complete there is no statutory right of redemption. The practical effect is that pre-foreclosure lists must be worked immediately in Virginia; a file that is a month stale is frequently finished. Confirm statutory detail with Virginia counsel — this is orientation, not legal advice.
Judicial tax sales, and a slower path for delinquency
In contrast to mortgage foreclosure, Virginia handles delinquent tax sales judicially: the locality files suit and the property is sold under court supervision, which takes considerably longer than the trustee route. There is no tax lien certificate market of the Arizona or Colorado kind.
For an investor that means Virginia distress splits into two very different speeds — fast on the mortgage side, slow on the tax side. Plan capital accordingly.
Vetting a Virginia contractor or agent: a short checklist
- Check the DPOR licence class — A, B or C — against your project value, not just that a licence exists.
- Confirm the specialty designation covers the trade you are hiring for.
- Work distressed leads immediately. With no redemption and short advertisement, weeks matter.
- Expect a judicial process on tax-delinquent property, and a longer timeline.
- Use a written draw schedule. Never fund ahead of completed work.
