The co-operative apartment trap
Pinellas has a large stock of residential co-operatives, particularly in its older 55+ communities — and a co-op is not a condominium. In a co-op the owner holds shares in a corporation plus a proprietary lease, not title to real property.
The consequences are substantial and routinely missed:
- What passes is personal property, not real estate. That changes how the interest is handled in the estate and how it is transferred.
- The association usually must approve the buyer, and many co-ops screen applicants, impose age restrictions and restrict or prohibit leasing. An investor plan that assumes you can buy and rent will often simply be refused.
- Conventional mortgage financing is frequently unavailable, so the practical buyer pool is cash.
- Maintenance fees accrue regardless, exactly as condominium assessments do.
The property type field is your first line of defence, but verify the specific community's structure before making an offer — county records and listings do not always make the co-op distinction obvious. Rules and community documents vary; confirm with Florida counsel and the association.
Condominiums, and why the building matters
Pinellas also has extensive condominium inventory, much of it older and coastal. Florida's post-2021 reforms brought milestone structural inspections for older buildings above a certain height and required structural integrity reserve studies with funded reserves. Across ageing Pinellas stock that has pushed monthly assessments up and produced special assessments in some buildings.
For an heir, a unit in a building with unresolved structural findings and a pending special assessment can be worth less than they assume — occasionally much less. Research the named building before you offer, and tell the family the truth about it.
The single-family half
