Homestead can pass outside the probate estate. Where the property was the decedent's homestead, it may descend directly to heirs rather than becoming an asset the personal representative administers. That changes who can sign, and when.

Devise is restricted. If a spouse or minor child survives, Florida limits how the homestead may be left by will. A will that appears to leave the house to somebody else may not operate as written — a genuinely distressing discovery for a family already grieving.

Creditor protection can continue. Homestead's protection from creditors may carry through to certain heirs, which affects what a buyer needs to clear and what the family is actually exposed to.

The result is that the homestead question — was this the decedent's home, or not? — determines the whole path. Your best clue in the file is the mailing address: where it matches the property, homestead is likely; where it sits in another state or country, you are probably looking at an investment or second home, which generally does not carry those protections.
