Pre-Probate Leads in Cook County, IL | ListCentral.US

Chicago built an enormous number of two-flats and three-flats, and a century later a great many of them are owned outright by elderly people who have lived upstairs and rented downstairs for decades.

When that owner dies, the heirs do not inherit a house. They inherit a small business with a tenant in it — and almost none of them realise what that involves. That is the defining feature of Cook County pre-probate leads and the basis of the most useful offer you can make here.

What pre-probate data is

Records linking a recorded death to a residential property still titled in the deceased owner's name, before an estate case is filed, from public death records matched against county property ownership.

Each Cook County record carries owner name and property address, owner mailing address, property assessed value, and parcel number and property type — that last field is how you find the multi-unit buildings. CSV, instant download. No heir, executor, phone or email; separate skip tracing required.

What transfers with a tenanted building

An inherited two-flat comes with obligations that do not pause for a death:

  • The lease continues. A tenant's rights do not end because the landlord died. Rent is still due, and so is the landlord's side of the bargain.
  • Security deposits are a real liability. Chicago's residential landlord-tenant ordinance imposes strict requirements on handling and returning deposits, with penalties for getting it wrong. An heir who cannot find records of a deposit taken in 2011 has a genuine problem.
  • Habitability and repairs remain the landlord's duty — including the heating obligation through a Chicago winter, which is not optional and is enforced.
  • Rent collection needs authority. Depositing a tenant's rent cheque generally requires someone appointed to act for the estate, which many families have not done. Money accumulates uncollected or, worse, gets handled informally.
  • Local registration and inspection requirements may apply to the building and do not lapse.

So the family faces a choice they are unequipped to make: become landlords, sell with the tenant in place, or sell vacant. Any business that can explain those three options clearly is more valuable to them than one offering a number. Ordinances and obligations vary by municipality within Cook County and change; this is not legal advice.

Cook County is far more than Chicago

The county contains Chicago plus well over a hundred municipalities — Evanston, Oak Park, Cicero, Berwyn, Skokie, Schaumburg, Arlington Heights, Des Plaines, Orland Park, Tinley Park, Oak Lawn, Wilmette and many more. Suburban Cook skews toward detached single-family housing and produces conventional estate situations. Some municipalities have their own landlord-tenant ordinances, which matters if the property is tenanted.

Estates are administered by the Circuit Court of Cook County, Probate Division. Illinois provides a small-estate affidavit route for smaller estates without real property, and supervised or independent administration otherwise.

The building itself

Cook County's housing is among the oldest in the country, and a long-held estate property typically needs: tuckpointing and masonry repair after decades of freeze-thaw, a boiler or steam system serviced by a specialist rather than a general HVAC firm, electrical panel replacement, galvanised or lead service line replacement, basement waterproofing and sewer work, and asbestos or lead-safe practice during any renovation.

Winter is the hard deadline. A vacant inherited building with the heat off risks frozen and burst pipes, which turns a manageable estate into an insurance claim and a gut renovation. An autumn letter offering a winterisation check is genuinely useful and almost nobody sends it.

Respectful and compliant outreach

  • Lead with the tenant question. "If your family has inherited a building with a tenant, here is what continues and what you need to do" is the most useful sentence available in this county.
  • Do not encourage anything improper toward tenants. Pressuring an heir to get a unit vacant quickly invites exactly the conduct Chicago's ordinances exist to prevent, and can expose the family to real liability.
  • Time winterisation offers to autumn. The risk is seasonal and the need is real.
  • Check your rules. State solicitation restrictions and licensing-board advertising rules apply, vary and change.
  • Never imitate official mail from the Circuit Court, the assessor or the city.
  • Mail first; honour do-not-call and consent rules if you append phones.
  • One no ends it.

Who uses it

  • Property managers — the single best-fit offer for an inherited tenanted building
  • Probate attorneys and landlord-tenant counsel
  • Investors who buy occupied multi-unit property and understand the obligations
  • Realtors able to market a tenanted building honestly
  • Boiler and steam-heating specialists
  • Masonry and tuckpointing firms
  • Plumbers and sewer contractors — service line and drain work
  • Winterisation and property preservation services
  • Estate clean-out and liquidation firms

What it costs

Cook County pre-probate snapshots are $0.20 per record, sold as dated weekly and monthly pulls with the record count in the product title. One-time purchase, instant CSV download, no subscription.

Compared with alternatives: court-record services cover filed estates, later and more competitive; probate-lead subscriptions bill monthly; rental registration and inspection data describes buildings but not deaths. Combining a county snapshot with your own unit-count research is the sharper approach.

Cook County pre-probate — FAQ

Can I find multi-unit buildings in the data?
The property type field is your starting point. For exact unit counts, match parcel numbers against property-characteristic data.

Does a tenant's lease survive the landlord's death?
Yes. A death does not terminate the tenancy or the landlord's obligations, and security deposit duties continue.

Who can collect rent after the owner dies?
Generally someone with authority to act for the estate. Families frequently have not appointed anyone, which is why rent goes uncollected or is handled informally.

Which court handles probate in Cook County?
The Circuit Court of Cook County, Probate Division.

Does it cover the suburbs?
Yes — Cook County includes Chicago and well over a hundred other municipalities, some with their own landlord-tenant ordinances.

How fresh is it?
Dated weekly and monthly snapshots from current county records. Last reviewed: September 2026.
