The two-state estate

Some plain distinctions worth understanding before you write to anyone:

  • Domicile drives the estate tax. Where the deceased was legally domiciled at death determines which state's estate tax regime applies to them. Living in one state while working in the other does not settle it, and neither does a mailing address.
  • Oregon's threshold is low. Oregon levies an estate tax from a threshold far below Washington's, so an estate that Washington would not tax at all can be taxable in Oregon.
  • Real property is taxed where it sits. A Washington decedent who owned a Portland rental, or an Oregon decedent who owned the Vancouver house, may have exposure on the other side too.
  • Property in two states can need two proceedings. An ancillary proceeding in the other state is sometimes required to deal with real estate there.
  • Neither state is the obvious answer. Washington has no income tax; Oregon has no sales tax and a lower estate tax threshold. The interaction is genuinely complicated.

Thresholds, rates and rules on both sides are statutory and change, and none of this is tax or legal advice. But a letter that simply says "if your parent's affairs crossed the river, the estate tax question has two answers and you should ask someone who handles both" is more useful than anything else a Clark County family will receive.

Washington's side of the process

Proceedings run through the Clark County Superior Court. Washington's administration is unusually light: where a will grants nonintervention powers, or the court finds the estate solvent, the personal representative can generally act without ongoing court supervision, including selling the house without court confirmation. One further local point: a great many buyers for a Clark County estate property come from the Portland side. A family in Oregon selling a Vancouver house is often selling to an Oregon buyer, and an agent who works both sides of the river is worth more to them than one who does not.
