Three reasons Miami-Dade estates sit

The personal representative restriction. Florida generally does not allow a non-resident to serve as personal representative unless they are related to the decedent in specified ways. Ancillary administration. Where the decedent was not a Florida resident but owned Florida real property, Florida property generally requires its own ancillary proceeding regardless of what is happening in the home jurisdiction. Homestead. Florida's constitutional homestead protections can cause a homestead property to descend outside the probate estate and restrict how it may be devised where a spouse or minor child survives. It is a frequent source of delay and of surprise.

Then use assessed value: a Homestead bungalow and a Key Biscayne unit are not the same transaction or the same channel.

Respectful and compliant outreach

  • Remember the distance. The recipient may be grieving in another country and dealing with a legal system they have never encountered. Condescension and pressure both land badly.
  • Explain, do not push. Information about the Florida process is the most valuable thing you can send.
  • Check your obligations. State solicitation restrictions and licensing-board advertising rules apply and vary; confirm what governs your licence and channel. If you are mailing internationally, local rules may apply at the destination too.
