North Carolina runs a foreclosure process no other state quite matches: a power-of-sale hearing in front of the Clerk of Superior Court, followed by a 10-day upset bid period in which a stranger can outbid you — and every successful upset bid starts a fresh 10-day clock. Winning a North Carolina auction is not the end of the auction.
The upset bid: why an NC auction win is provisional
After the trustee's sale, a report of sale is filed with the clerk and a 10-day upset bid window opens. Anyone may raise the bid by the statutory increment — generally 5% of the prior bid, with a minimum of $750 — by depositing with the clerk. Each qualifying upset bid resets the ten days from scratch.
The practical effect is that your capital is committed while the outcome is not. A property you "won" can be taken weeks later by a bidder who never attended the sale. Budget for the hold, and never book a crew off an auction win until the upset period has actually run out. $40,000: the line that decides whether a licence is required at all
North Carolina licenses general contractors through the NC Licensing Board for General Contractors, and the trigger is project value. A general contractor licence is required for work valued at $40,000 or more. Below that figure, no GC licence is required.
Above it, licences are tiered by the contractor's working capital rather than by the job — Limited, Intermediate and Unlimited. Electrical, plumbing and heating trades are licensed separately by their own boards whatever the value. So on a $35,000 cosmetic rehab you may be dealing with an unlicensed and perfectly legal operator, while on a $120,000 gut you need to confirm the classification actually supports the number. Verify current thresholds with the board; they are revised periodically.
Everyone is a broker: North Carolina has no salesperson licence
North Carolina abolished the salesperson licence outright. The Real Estate Commission issues a single broker licence, which runs from provisional broker — who must be supervised — through full broker, with broker-in-charge as a separate designation carrying supervisory responsibility for an office.
"Broker" on a North Carolina business card therefore does not mean what it means in most states, and it implies no seniority at all. If you need someone who can operate independently on an assignment or a portfolio sale, ask directly whether they are still on provisional status and who their broker-in-charge is.
Tax delinquency is foreclosed, not sold as a certificate
North Carolina does not sell tax lien certificates. Counties foreclose the lien themselves, either through a mortgage-style action or the in rem procedure under the Machinery Act, and the property is sold at auction. Those sales carry the same 10-day upset bid period, so the timing problem above applies to the tax side too.
That rules out the passive certificate strategy that works in Florida or Arizona, and pushes North Carolina tax-distressed work upstream — toward a delinquent tax list worked directly with owners before the county files, rather than bidding after it does.
What this means for working NC leads
The clerk hearing and the upset bid make North Carolina slower after the sale than Georgia or Virginia, but the pre-sale window is still short. Pre-foreclosure data is best worked before the power-of-sale hearing is scheduled, while the owner still has options and before the file becomes public competition. Probate and absentee owner records behave conventionally here and reward the usual county-level discipline.

- Ask whether the project crosses $40,000. That figure, not the trade, decides whether a GC licence is legally required.
- Check the classification — Limited, Intermediate or Unlimited — actually supports your project size.
- Get electrical, plumbing and heating licence numbers separately. Different boards issue them.
- Ask an agent whether they are a provisional broker, and who supervises them.
- Never commit a crew off an auction win. The 10-day upset period can reset repeatedly.
- Get a certificate of insurance naming you and confirm it covers the actual scope.
- Use a written draw schedule. Never fund ahead of completed work.
