Pennsylvania has the one tax that changes probate investing more than any other state's: an inheritance tax charged on the heir, not the estate, at a rate that depends on the relationship to the deceased. It is also a judicial foreclosure state, and Philadelphia offers a distinctive route into blighted property through Act 135 conservatorship.

Inheritance tax is why Pennsylvania heirs sell

Pennsylvania levies an inheritance tax on most transfers at death, with the rate set by relationship: 0% to a surviving spouse, 4.5% to lineal descendants such as children, 12% to siblings, and 15% to other heirs. Real property is within the base, and the tax is generally due within nine months.

The practical consequence for an investor working probate lists or pre-probate data is that an heir who inherits a house frequently has a cash obligation and no cash. A niece or nephew inheriting at 15% has a strong reason to transact quickly. That is a genuine motivation, and it is specific to Pennsylvania among the states in this directory. Registration, and the Act 91 notice

Pennsylvania does not licence general contractors. Under the Home Improvement Consumer Protection Act (HICPA), contractors performing home improvement work above a low annual threshold must register with the Office of Attorney General and display the registration number. Electrical and plumbing are handled at municipal level.

On the distress side, owner-occupied residential mortgages generally require an Act 91 notice before foreclosure, offering the homeowner access to counselling and a state assistance programme. That adds time at the front of the process. Foreclosure itself is judicial, ending in a sheriff's sale. Verify registration with the Attorney General's office and procedure with counsel.

Act 135: conservatorship of blighted property

Pennsylvania's Abandoned and Blighted Property Conservatorship Act lets a qualifying party petition a court to be appointed conservator of a blighted, abandoned building — with authority to stabilise and rehabilitate it, and in some cases to sell it. It is used most in Philadelphia.

It is a court process, not a purchase, and it carries real obligations and cost. But for investors focused on vacant inventory with tangled title, it is a route that does not exist in most states. Take Pennsylvania counsel before considering it.
